What BOOMIN is
BOOMIN (boomin.app) is where startups (brands) and people who post on X (creators) agree on paid posts: sponsored posts, quotes and reposts. Brands describe what they are launching and send offers; creators set their rates and accept, counter or decline.
BOOMIN runs the marketplace. It is not a party to any deal made on it, it does not post on X for anyone, and it does not promise any number of offers, views or results.
These terms are the agreement between you and BOOMIN. By creating an account you accept them. If you use BOOMIN for a company, you confirm you may act for it, and “you” includes the company.
Your account
- You must be at least 18 and able to enter into a binding agreement.
- You sign in with your email address or Google. Keep that access to yourself: you are responsible for everything done through your account, and you tell us right away if you think someone else has it.
- Give us accurate details and keep them current. One person, one account.
- We may ask you to confirm who you are before you use some features.
Brands
- Brand accounts are invite-only for now. Only people we have invited can set up a company.
- Your company profile and every brief must be accurate. What you ask creators to promote must be lawful, and the claims in your brief must be true and substantiated.
- Set a budget you will honour. A creator who accepts your offer is counting on it.
- You are responsible for your product, your claims and anything you ask a creator to say or link to.
Creators
- Anyone can apply as a creator. We review every application and may approve it, ask for changes or decline it, and we may change that decision later. Only approved creators receive offers.
- The X account on your profile must be yours. Your rates, audience numbers and past collaborations must be accurate. An X Analytics screenshot you add must be your own.
- You decide which offers to take. Nothing on BOOMIN obliges you to accept one.
- Keep your profile up to date; brands decide from what it shows.
Offers, launches and deals
A brand reaches creators in two ways: a direct offer to one creator, or a launch, which either sends offers to the creators that fit it best or opens a call that fitting creators can join. Every offer states the format, the fee, the brief and, once set, the publishing time.
- A creator can accept, counter with a different fee, or decline. The brand accepts or declines a counter-offer. An offer can carry a deadline; one that is not answered in time expires, and the launch may offer that budget to someone else.
- When an offer or a counter-offer is accepted, the brand and the creator have made an agreement with each other on that format, fee and timing. BOOMIN is not part of it.
- The brand sets the publishing time. The creator writes and publishes the post on X themselves and adds its link in BOOMIN.
- Results (views and engagement) are read from X after the post goes out. They can differ from what X shows you.
- Both sides keep their conversation in BOOMIN and answer each other in reasonable time. If something changes, say so there.
Payments and fees
- BOOMIN does not process payments yet. The brand pays the creator the agreed fee directly, promptly after the post goes out, unless the two agree otherwise.
- Creators pay BOOMIN nothing: the fee a creator agrees to is the fee they keep.
- Brands pay no BOOMIN fee today either. Before any payment runs through BOOMIN or any fee applies, we will update these terms and tell you.
- Payment disputes are between the brand and the creator. We can show both sides what was agreed in BOOMIN.
Posts and disclosure
- Creators write their own posts and are responsible for them. A brand may ask for changes in the conversation but does not control the creator’s account.
- Every paid post, quote or repost must be clearly disclosed as an ad where the law or X’s rules require it, for example with #ad.
- Everyone follows X’s terms and rules. Buying or selling fake engagement is not allowed.
- The creator keeps the rights to their post. Unless the two agree otherwise, the brand may repost, quote and link to the public post on X, and may not edit it or use it elsewhere.
- A brief can describe something not yet public. Keep it, and anything else the other side shares in a deal, confidential until it is public, and use it only for that deal.
What you share with BOOMIN
You keep ownership of what you add to BOOMIN: company details, profiles, briefs, messages, drafts, post links and screenshots. You give us permission to store, process and show it as needed to run the service, for example showing a brief to the creators it is offered to, or a creator’s profile to the brands it fits. A screenshot you upload is read for the audience shares it contains and is not kept.
Feedback you send us is welcome, and we may use it without owing you anything.
Fair use
Don’t use BOOMIN to:
- send spam, or offers and messages that are not about a real deal;
- promote anything illegal, misleading or harmful, or buy, sell or fake engagement;
- pretend to be someone else, or use an X account that is not yours;
- scrape, copy or probe the service, get around its limits, or break into other accounts;
- take a deal off BOOMIN to avoid its rules, or contact the other side for anything other than the deal.
X and other services
We read public information from X through a third-party provider: a creator’s profile, bio, recent posts, follower count and the views and engagement of published posts. Models read a brand’s public website, a creator’s recent posts and an X Analytics screenshot to fill in profiles and suggest matches. Those readings can be wrong; check what they filled in before you rely on it. X and those services have their own terms, and we do not control them.
Suspension and closing
- We may suspend or remove an account that breaks these terms, puts others at risk, or stays inactive for a long time. Where we can, we tell you why.
- You can stop using BOOMIN at any time and ask us to delete your account at hi@boomin.app. Deals you already agreed to stay between you and the other side.
- Sections about content, confidentiality, liability and disputes keep applying after an account closes.
The service, as it is
BOOMIN is new and changes often. We provide it as it is and as available: we may add, change or stop features, and we do not promise it will be uninterrupted or error-free, that any offer will come, or that a post will perform. Nothing in these terms limits a liability that the law does not let us limit.
To the extent the law allows, BOOMIN is not liable for indirect, incidental or consequential losses, for lost revenue or profit, or for what brands and creators do or fail to do under the deals they agree. For everything else, our total liability for all claims about the service in any twelve months is limited to what you paid BOOMIN in those twelve months or, if nothing, $100.
If someone brings a claim against BOOMIN because of your brief, your post, your company’s product or your breach of these terms, you cover the costs that claim causes us.
Changes to these terms
When we change these terms in a way that matters, we tell you by email or in the app before the change applies. If you keep using BOOMIN after that, the new terms apply. The current version is always at boomin.app/terms.
